And yes he can own this idea, its called intellectual property. Which is defined as a work or invention that is the result of creativity, such as a manuscript or a design, to which one has rights and for which one may apply for a patent, copyright, trademark, ect. So yes by law he owns the idea.

i completly agree that this is copied, plagiarism is difined as the practice of taking someone else's work or ideas and passing it off as one's own. and synonyms include copying, theft, stealing, and piracy. So yes he did copy it, and adding a little snow wont fix that. Its like copying something offline and adding a few of your own words then saying it is your own.
